Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at info@lusbrands.ca with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.We do not currently sell covered information as defined under Nevada law, but you may submit a request to opt-out of future sales.

Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision.  In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

International Data Transfers

By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to LUS (Love Ur Self) Brands in Canada, and you authorize LUS (Love Ur Self) Brands to transfer, store and process your information to and in Canada, and possibly other countries.  You hereby consent to the transfer of your data to Canada pursuant to: (i) a data processing agreement incorporating standard data protection clauses promulgated by the European Commission, a copy of which can be obtained at https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex%3A32010D0087, (ii) binding corporate rules for data protection that align with the GDPR’s requirements, or (iii) adherence to an industry- or technology-specific approved code of conduct blessed by the European Commission .

Personal Information may be transferred from users residing in the European Union to our servers, partners, or vendors located in the United States and other non-EU countries where there may not be an adequacy opinion issued with respect to that country. We have taken appropriate safeguards to ensure that Personal Information remains protected wherever it is transferred.  When we transfer Personal Information of individuals in the European Economic Area (“EEA”), Switzerland or the United Kingdom (“UK”) to the US, we make use of the Standard Contractual Clauses and the UK Addendum as well as additional safeguards where appropriate. We are also certified to the EU-US and Swiss-US Privacy Shield Principles to help safeguard the transfer of information we collect from the EEA, Switzerland and the UK.

We take all reasonable steps to protect the information we receive from you from accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access. We have put in place appropriate physical, technical, and administrative measures to safeguard and secure your information, but no security measures are perfect; the risk of a data breach is possible. We review our security procedures and implement updates in response to emerging threats or best practices.

California consumers:  We will not sell the information of California consumers who are 16 years old or younger unless we have prior parental authorization.  If a California consumer is under the age of 13, a parent or guardian must consent to the sale of such minor’s personal information.  If the California consumer is between the ages of 13 and 16 years old, the minor may consent on an opt-in basis to the sale of their personal information.  Our sites directed toward children will ask for age verification and will require appropriate consent.
